Want clarification on legal heir certificate after mother's death

We own a land in my father and mother name in joint. My mother passed away and I received death certificate. Can I apply for legal heir ? And should mention legal heir my father and my name and my brother name or else only myself and my brother name ?

No you should right your brother name suppose if you don't right your brother name after you have face some problem way of your brother

Upon the death of your mother, her share in the property shall devolve equally upon your father and you and your brothers and sisters. You have to include all these persons in the legal heirs certificate.

If you are applying for legal heir certificate from the competent authority you have to mention your fathers name and your brothers and your name. Strictly speaking it has to be applied by your father and after him only your legal rights emerge.

Your father will also be included in the legal heir certificate as he has a share of right over his wife's property. You all will jointly own the property with respect to your mother's share and your father owns his share alone

Yes. For your mother all her children and your father are legal heirs. Therefore while you apply for legal heir certificate you need to give all those information to enable the Revenue officer to issue a certificate accordingly .
