Parents refusing share of property to daughters

06-May-2023 (In Property Law)
I have a brother and sister. Our parents are refusing to give any share to us sisters from our ancestral properties. Father has some properties which he acquired by selling ancestral lands and these are registered in my mother's name for almost 20 years How will I be able to get my share when 1. Most property details are hidden from us daughters and we are not in possession of any property documents. 2. Many properties are transferred/purchased in my mother's name. 3. Some properties are already transferred in joint names of my mother and brother

you can claim according to Hindu Law, by law, a father cannot WILL such property to anyone he wants to, or deprive a daughter/sin of their share in it. By birth, a daughter/son has a share in the ancestral property.

Yes very well you can claimyour share out of this ancestrsl property of from the property which has been purchased by proceeds of selling off the ancestral property by your parents.
However if you donot know the details of property /properties you can file a suit for partition and declaration mentioning that these properties has been purchased by the sale proceeds of some ancestral properties. Which you have to show in the Court and prove. please note any document which is 25 years or more than that years old can not be questioned in the court as wrong document. Find carefully details of properties first and the method of purchasing those out of the same money of sale of ancestral property and then only file the case.

By birth, all descendants are entitled to an equal share of such property, whether they be sons or daughters. Prior to 2005, only sons were entitled to a share of such property. A father is not allowed to give his property to anyone or to deny a daughter her share. A daughter inherits ancestral property by birth.
