Boundary dispute with neighbour as they dont have proper clearance

I have dispute with neighbour regarding the wall compound (boundary dispute). We have all the required documents. Also our building is Plan Passed and authorized by Corporation. Our opponent does not hold any legal documents. We have filed a FIR on them. In police station they were asked to submit the relevant documents but they did not. Please advise if this can be soughted at police station or need to file a case.

This is a pure civil case and for permanent relief you should file a civil suit in court of law. Before proceeding further i need to check the original/certified copies of documents of land and building with you like city survey sheet, boundary demarcations, 7x12 extract of the land with mutation entries etc and all other relevant papers. kindly visit my office with all documents you have if possible for perfect solution. thanks.

Your case is of illegal encroachment and tresspass. Trespass is a civil wrong as well as a criminal offence. You can file a civil suit for tresspass within one year from the date of cause of action simultaneously with your criminal action.

If the dispute is about land and if you are the owner of your land. Then you need to make any an application to the concerned Survey officer for demarcation of your property . Thereafter notices will be issued to the adjoining pot owner and propewrties boundaries will be demarcated.
