Common pathway is occupied by land behind

We have north facing house with union road in west side and 8ft path has been common in north side. we have gate in west and noth sides. New house built behind our house and 8ft common path has been covered using compound wall. Now that owner shouting us not to use north side 8th feet path and ordering us to use west side gate only. Also they have remove our few of our small plants planed in touch with our wall.

you can make a complaint to your local municipality against him for making encroachment and damaging your property. simultaneously you can also file a police complaint against him and the persons who are making the construction. if these does not work then you will have to file a suit against him restraining him from making any type of encroachment on your property.

civil rights are violated then you should approach Civil Court for permanent injunction not to occupy the common pathway remedy Civil Court Civil Court will declare what is the right in the common pathway and what is the rate of you and what is a right of the opposite party you decide this one the other party will encroach the common pathway so bad advice to go for civil litigation through an injunction suit
