Regarding right of easement through property free of cost
29-Aug-2023 (In Property Law)
I and my siblings have our plots of land (acquired through partition deed) side by side. I also have a 10 ft wide narrow plot connecting the panchayat road to my plot (this pathway plot bought self-acquired by me - not inherited). Now my siblings want to use that 10 ft wide pathway plot (bought by me) and continue using it through my property (inherited through partition) to reach their plot.
Right now there is no obstruction to them using the 10 ft plot or a path through my land. but in near future I want to build a compound wall around my land.
As per Kerala law what is the width of the easement that can be lawfully claimed by my cousins through my property?
Can my cousins claim a 10 ft wide pathway through my property to reach their plot free of cost?
a property without a pathway is not at all possible in india. as per the prevailing law, a pathway having a minimum width should be provided to all the property for the ingress and egress to the property
