Can I quit my job during probation without serving a notice period?

18-Feb-2023 (In Labour & Service Law)
I recently joined a company and planning to leave it after getting my first salary because I found a better opportunity. I'm still on probation. In my contract it's mentioned that either party can terminate the contract by serving two months of notice. However, in case of probation, the employer can terminate with 1 week notice. Nothing is mentioned about what the employee has to do. I don't want an experience letter or any F&F from here. I've not taken any assets or joining bonus from them. So do I have to serve any notice?

If there is no mandatory clause to serve the notice period while resigning then you would not be bound by one. However for better clarification just drop your formal resignation via email to the HR and confirm the same. For any further legal assistance please feel free to contact

In cases where misconduct has not occurred, the standard notice period (whether you have a contract or not) is 1 to 2 weeks during probation. However, the amount of notice you have to give is also dependent on the award you're classified under. Similarly, it also comes under the industry that you work in.
