Property division between sibling after the death of parents

We are two brothers and 3 married sisters Hindu. Our parents and elder brother died. How can we share our land as well as residential property

Dear Sir.
Ancestral property are always divided in metes and bound by way of partition in between the legal heirs and successors. So you can share your property by way of partition in between you either amicably or by the court of law through ba partition suit.

If the relationship is congenial ,have mutual partition and then some one should file a partition suit through a lawer and produce partition understanding in the court with evidence and get the decree. Expenses will be less compared to other process otherwise in contest each and every property will be 5 parts .

According to law the property of your parent will be divided equally among all the legal heirs of late parent.Both daughter and son will get equal share.Partition can be done through Regd.partition deed or civil Court partition

If the elder brother don't have any heir or died unmarried then the property will be devided equally among living siblings. If brother have any widow living or living children then they can also claim your brother's share in the property. You can file a partition deed in the appropriate civil court.

You are advice to file civil case for partition of the entire property in the name of your parents and elders in the civil court. If all are agreed with the decision of partition of property then it end mutually
