Division of property between a brother and sister after parents death

Sir, My husband has one sister who is married but separated from her husband and living with us with her son for the last 18 years. Our house is on a 10 cents land in Kerala which is in their mother's name but father spent money to construct that. Now she wants her share and not ready to go anywhere.She acquired her husband's home legally in her son's name. Please advice how to divide the property as per Kerala Hindu law. She depend us to live but claim that it is her father's property and ask me to leave the house. I cannot go back to my parents home and helpless. regards

In this case, you are advised to ask your husband to file a partition suit in the proper civil court. So that the property will be either partitioned or any of the parties can purchase the share of the another and get this property free. The case can be settled in the court mediation also with your husband's sister in the case.
