Legal actions against the husband who is not living with me

12-Jun-2023 (In Family Law)
We have been married for 3 years now and working in different cities. it was decided before marriage that husband will relocate. However, for past 3 years, he has been making excuses. Neither he shifts, nor does he let me shift. He visits me only at his free will, and only tells false stories about his plans to shift. What legal actions can i take against him?

There is no legal remedies if he is not living with you because you can't force to ypur husband to live with you now if he is not giving you maintenance so there is remedies, you will take divorce from him reason is this we will show then he has to come with you

You can file a petition in the family court for Restitution of Conjugal rights with the help of lawyer for cohabitation with you husband. Also you can claim maintenance and can also seek for divorce if you don't want to continue your marriage. This all can be done with the help of lawyer.

First of all you need file restitution of conjugal rights under section 9 of Hindu marriage act.
Then we have to see further what he’s willing to do

You can proceed with the law laid down under the Hindu marriage act. Provisions under Hindu marriage act give you the courtesy for the court to give directions to the spouse to fulfil his duties as a husband. The most effective way is to send a legal notice for restitution of conjugal rights and later proceed with the same in court.
