You can lodge a police complaint against your boy friend for having sex with you on the pretext of marrying you and cheating on you and prosecute him for his cheating on you from marrying you. you need to give a detailed and proper complaint before police.

You could file a criminal complaint against him. But now a days the courts are not ready to hear the non consent plea and cheating plea raised by the educated mature girls. If you are ready to wage a protracted legal battle which may ultimately fail, you could approach your local police station and file a complaint.

You can give a complaint to the Police and punish the person. You can see that he is arrested and put in jail. Do you want to marry him or only punish him? Do your parents know about the issue? If your parents don't know, then it may become difficult to take action without their knowledge. You can contact me for a detailed discussion so that I can give a clear and proper guidance.

In India, the legal implications of a breakup and refusal to marry can vary depending on the circumstances. Here are some key points to consider:
  1. Breach of Promise to Marry: Under Indian law, a breach of promise to marry is not considered a criminal offense. Therefore, you cannot file a criminal case against someone solely for breaking off an engagement or refusing to marry.
  2. Civil Actions: While there may not be criminal consequences, you may have civil legal remedies. You can explore options like filing a civil suit for damages if you have suffered financial losses or emotional distress due to the broken promise.
  3. Mental Harassment: If the breakup involves severe mental harassment or cruelty, you may consider filing a case under laws related to cruelty or harassment. However, you would need to provide evidence to support your claim.
  4. Supreme Court Judgments: The Supreme Court of India has issued judgments clarifying the legal position regarding false promises of marriage. These judgments emphasize that a mere breach of a promise to marry does not amount to a criminal offense.
  5. Legal Advice: It's advisable to seek legal counsel to understand your specific situation and explore the available legal options.
