Q: How much marriage expenses and maintenance can wife claim ?

Dear sir/madam, I got married on 2015. I want to file for divorce against my wife on mental cruelty and adultery. I am having evidence for her adultery messages with her boy friend. If i initiate divorce how much amount they can claim for marriage expenses and for maintenance. They would have spend 10 laks for marriage, but i know they will claim around 30 laks. I am from poor family and i cant event give 3 laks. I am 25 years old. Can u clear my doubt that can marriage expenses be claimed in divorce? whether i have to give all the amount which they spent for marriage. Please suggest me how can i negotiate the marriage expense money. On which basis they can claim money. We both are hindu.

If you prove that your wife lives in adultery you need not pay for her maintenance. The permanent alimony is allowed not based on the marriage expenses. It is decided by the status of the parties concerned. It is now well settled that one fourth of the husband salary or income could be awarded as the maintenance. Your income, standard of living and expenses you need to spend on your family etc would be considered to arrive at a sum to be paid by you.

You could file a criminal complaint against him. But now a days the courts are not ready to hear the non consent plea and cheating plea raised by the educated mature girls. If you are ready to wage a protracted legal battle which may ultimately fail, you could approach your local police station and file a complaint.

You can move an application to return your jewels and things. You did not mention under which provision you filed complaint. If it is DV proceddings you can file an application in the DV procedding iteslf. You can approach the family court also for the same remedy.

The court has ordered to attend counselling for the Divorce case filled by my relation. He has attended 2 counselling sessions and conveyed his decision. The counselor has asked him to attend 3rd session by next week. Is it mandatory for him to attend the 3rd session without fail? Is it fine if his lawyer go the counseling Desk and convey the message? Once you engage any advocate , follow his instructions. He or she is the person who knows your case particulars and in a better position to give you advice. Asking in a public forum without any details and cross checking your advocate is not right thing to do. Meanwhile, it is the practice of 3 counselling is mandatory and judge may again ask him to attend counselling on the next hearing.

you can file the divorce petition on the ground of cruelty. Apart from filing a petition for divorce, you can also seek maintenance and if you have any child you can ask for them also. If you have any abusive emails or messages they can be produced as the proof for cruelty.
