The judge sanctioned interim maintenance of 10,000 rupees for my baby. How to ask interim maintenance for me from my husband?

The proceedings are the same for the baby and mother. You have to repeat the same procedure. If you are a party in the main proceedings , you can file an interim petition for you also. Otherwise you have to file another case. why did you not seek maintenance for you along with your child?

The child custody is a complicated area and it could be answered after assessing all the particulars related to the case. so consult an advocate to get a clear understanding. However, taking the child forcefully may not help you in the long run.

Q: Divorce case filed against my husband , due to criminal cases

I have already filed my Divorce case in family court, Its been 2yrs now ,still not even a 1% improvement.I dont know what else to do this part now they were saying again we need to wait 2more months due to summer vacation .Recently ,they have filed interim pettion also.The problem between us , he was lied that he completed B.E and have job in tech companies, he didnt compelet 12th also ,I found this after my marriage. And also, he was involved 2major case that is also he didnt tell bfr marriage

Generally, the proceedings before the family court takes time. if you give further details such as Stage of the petition ,it would be easy to advise you. The main enquiry would be conducted only after the disposal of IAs. so the filing IAs would lengthen the time.

Q: Contested divorce apeal after 120days of orginal degree

I'm a christian. I got contested divorce from my first wife. After 90 days from the degree date I got remarried. After appeal period My ex-wife has filed an apeal in HC with delay petition 151CPC section 1681 . I got private notice to appear in HC after 6 months from the orginal degree date. Any possibility to showing my second marriage and ask the HC to dismiss the apeal as it has been filed after apeal period? Is my second marriage valid? Will it come under bigamy?

Usually the delay is calculated from the date of receipt of the order copy. Usually , the courts would consider the current circumstances and try to pass suitable orders. But there are cases where despite the second marriage, the divorce decree was set aside. As per my understanding , you married after the Appeal period , so it would be considered Bigamy. You can contest the delay condonation petition and the appeal on merits.

Q: How to reply to Divorce notice

My wife and me are separted for 7 years after a year of marraiage, Their parents doesn't let her to have sex with me for almost a year. The reason was they want me to go to sepearate house and do not give any money to my parents, After a year, we needed a baby and had sex 2 times and were blessed with baby boy. Then she went to my in laws house and stay with them permanently. Now my wife says I'm incapable for sex and sent divorce notice and asking for 1 Crore alimony.

you have to rebut her allegation and put your counter allegation in a coherent way. You must prepare it as an answer to her claims and add points to support your case. If she files a petition on the court, it will be one of the evidence.
