In response to your query. You are very much entitled to file a case for Domestic Violence with the subsequent repercussions against your spouse. Please do note that it would be beneficial for your case if you have any proof of such domestic violence. Any marks pertaining to injuries, doctor's reports etc. which could substantiate your cause.

Pertaining to Divorce that can be initiated by sending across a legal notice, and thereafter proceeding with Divorce under cruelty. You should also file an application under S.125 CrpC for maintenance .
