What to do with the stridhan of my wife

15-Jun-2023 (In Divorce Law)
i got married 1 year ago.we are not living together for past 6 months.i hv some jwellery of her in my home.actually i did take gold loan with that for my education with her consent but recently i hv refunded loan and took the gold from bank because i dont hv any proof of her consent.i am fearing she wl file 498a or 406. so what should i do of that stridhan. 1)should i give notice to her to take return ur things or should i keep quite and let her ask for her things? 2)does bank hv any proof that her same jwellery was kept for loan i.e.some photos of that jwellery?

What is the valid source of stridhan?

Stridhan is the owner of property acquired through self-exertion or mechanical arts.

What is the evidence of stridhan?

Stridhan covers all gifts, movable and immovable, received by a woman prior to marriage, when she married, during childbirth, or during widowhood. The court will not necessarily consider a womans list of assets if it is signed by two witnesses.

This is my response to you:
1. Let her ask for the stridhan, but also do not take further loans on it;
2. Bank would have maintained the records of taking that gold;
3. But even if your wife asks for the records, the banks will not provide them;
4. The banks have to respect your privacy and its against banking regulations to disclose information about customers in family disputes and divorce matters.

Dear Client,

I understand your worries. But the query is not fully explained as to why both of you are living separately and what is her intention as per your perception. Whether it was arranged or love marriage ? etc.

You may contact me with details of information and evidence for further advise and suggestions on the matter.
