What to do when wife is not willing to stay with husband at his place?

Hello sir I got married in April 2016. My wife is from a city and I belong to a small town than her. We discussed it before marriage. Now she says she doesn't like the city and wants me to move to a big city. Before marriage she said she doesn't want to work but now she says she can't stay at home.she always fights with me and has gone back to her parents for the past 6 months.no communication from them. I called her back several times but she says she will come back if I promise to move to city which is not possible because I have an established business here. Can I approach the court ??

Hello sir, Marriage is a sacrosanct in nature and not a contract.I presume that you are a Hindu and If your wife is not intending to join your conjugal society, then you can send a legal notice of DVR (Restitution of Conjugal Rights), as your right to have company is violated by your wife and she is obliged legally to perform the marital obligations/duties . In such case you have to send her a notice for ROR Restitution of Conjugal rights asking her to join your company and to live a happy and married life. If she does not respond to the legal notice then you have to file a case in the court then the court will send her notice and rest what she will file in reply will be considered by the court. You should file a restitution of conjugal rights petition in the court nearest to you and ask your wife to rejoin you in the marital home (your city).
No courts can pressurize you to relocate just because your wife wants to live in a city.
You should be able to demonstrate to the court that you are engaged in a business in the city of your residence and that the business is a primary source of your income and also that your current residence helps you to take care of your parents, properties etc.
