Q: What to do when wife not willing to stay with husband at his place?

Hello sir I got married in April 2016. My wife is from a city and I belong to a small town than her. We discussed it before marriage. Now she says she doesn't like the city and wants me to move to a big city. Before marriage she said she doesn't want to work but now she says she can't stay at home. she always fights with me and has gone back to her parents for the past 6 months.no communication from them. I called her back several times but she says she will come back if I promise to move to city which is not possible because I have an established business here. wife doesn't want to stay with husband , Can I approach the court ??

Advocate Mohammed Abdul Quadeer answered
HI,In such case you have to send her a notice for ROR Restitution of Conjugal rights asking her to join your company and to live a happy and married life. If she does not respond to the legal notice then you have to file a case in the court then the court will send her notice and rest what she will file in reply will be considered by the court. Q: What is the vide separate order meaning in a civil judgement ?

We filed a suit against a common property share. After 3 years, this is the judgment note provided. What is the meaning of this? As a plaintiff, have we won the case or not?
Judgment pronounced. (Vide Separate)
In the result, what is vide separate judgment meaning? The suit stands dismissed. No costs.

Advocate Mohammed Abdul Quadeer answered
Hi, as per the information, since the judgment states "dismissed," it means that the court has not granted your request. Vide order meaning signifies that the details of the judgment are provided in a separate order. You have lost the case, so you should obtain a copy of the order and consider filing an appeal against the same.

Q: What does it mean by case status: call with IAS ?

what does call with ias means in court ? my case present status call with ias. call with ias 22times repeating showing this word

Advocate Mohammed Abdul Quadeer answered
Hi, you haven’t mentioned whether you have a lawyer for your case or not, and whether you are the one who filed the case or are defending it. This information is important to understand your role in the matter.

If any party has filed an Interim Application (IA) for temporary relief — such as a stay order, injunction, or any other interim request — and it is still pending, then the case status may be shown as "Call with IA" or "Call with IAS" in court records.

This means the court has listed your main case along with the Interim Applications (IAs) for the next hearing. The court may call both parties to:

  • Hear arguments on the pending IAs
  • Ask for counter filings
  • Or pass an interim order before continuing with the main case.
Make sure to check with your advocate or engage a lawyer if you haven't already to understand the case status. Call with IAS clearly.

Q: What is the process for the cancellation of an injunction order? Specifically, how to stop an injunc

We bought a property many years ago, but the owner has sold it again. As a result, we received an injunction order to stop construction. How much will it cost to cancel that order? Can we apply to cancel the injunction order through online means? Specifically, how to stop an injunction order from court, how to cancel an injunction order, and how to remove an injunction order?

Advocate Mohammed Abdul Quadeer answered
Hi, As you said that your owner had sold the property to you first and later to someone else. If you are in possession then their injunction order can be of no use. For cancellation of court order you have to appoint an advocate and you have to file counter in court for cancellation of Induction order. Call us through website for assistance

Q: How to claim right in the ancestral property sold by father and time limit to claim ancestral proper

My father had sold our ancestral property in 1998 and 2005, but my brother and I were unaware of these transactions. For the other ancestral property sold, we were part of it, but for the ones sold in 1998 and 2005, we received no share. However, the revenue records still show my father’s name. Please tell us how we can get our rightful share in our ancestral property. Are we barred by the law of limitation? Is there any time limit to claim ancestral property? Can I claim ancestral property after 30 years? What is the time limit to claim ancestral property in India? Please provide a brief answer and mention the required documents.

Advocate Mohammed Abdul Quadeer answered
Before proceeding, confirm whether the ancestral property legally devolved upon you and your brother. If you are entitled to a share, you can file a case. Since you were unaware of the transactions, you may still have a valid claim. Required documents include revenue records, pahanis, encumbrance certificates, and sale deeds.
