Second motion due but the Judge has expired, what will happen to the c

22-May-2023 (In Divorce Law)
Hi, my 1st motion was done in February and we were thinking of applying for the 2nd motion as both the parties are staying seperate for the last 5years. Unfortunately the Principal Judge has expired. Now the court is vacent. When will the new judge come and how will the case proceed?

The case will proceed as from the stage it has been pending from. Also there is no time limit for appointment of any judge. It can be done shortly so be in touch with your lawyer so that you can get to know your next date of hearing. For any further legal assistance please feel free to contact
Thanks

Hello Ma'am,

Please go ahead and file the matter, the seat of the judge will not remain vacant forever. And the matter will be taken up by the new Judge comes. There is no point holding the filing of the second motion back.

Second motion will be moved in same court, it won't affect your case if principal judge has expired. you may move second motion even now but your matter will be taken up when new judge will be appointed.
