RCR - Can I go to matrimonial home

My husband has filed RCR ( counselling stage) . I have filed DV ( Interim argument). Both the cases are ongoing from last 2 yrs.Since my husband is not attending any of the court matters regularly , My question isn1. Can I directly go to my matrimonial home with my kid as I want to stay with my husband? n2. Will they allow me to enter in their home?nnPls guide.

You can go and stay there as they can't evict you and your accommodation right. If he had filed case under restitution of the conjugal rights then you can say that even after Domestic violence case I m trying best to save my marriage life.

in the absence of any prohibiting order to enter in your matrimonial house, you and your kids have full right to enter, reside and stay in the house. even otherwise your husband has already filed RCR

Yes you can go to your matrimonial house whenever you want to even you there after legal proceedings pending against you and if there is no restraining order against you granted in favour of your husband for further query you can contact

hello can go directly to your matrimonial home if they denies you Tu stay with them then you can find restitution of conjugal right under section 9 of Hindu Marriage Act and in it if your husband doesn't appear will make ex Parte order with help of that order you can go there but this is a legal way I will suggest you go directly and convince them add your own

An aggrieved person or a Protection Officer or any other person on behalf of the aggrieved person may present an application to the Magistrate seeking one or more reliefs under this Act: Provided that before passing any order on such application, the Magistrate shall take into consideration any domestic incident report received by him from the Protection Officer or the service provider.
