Mere shadi ko 10sal hogye hai. Mere 5sal ka beta hai lekin mere partner mentally nd physically harass krte hai. I can't take any step due to culture believes nd mujhe laga tht he will be better one day. But ab mere s n ho pa rha hai he is in defence nd divorce n dena chahte even dhmkiya dete hai ki kar jayege . Mai financial strong hu mujhe plz koi way btayiye jis mai bina jhgde aur sage rhkr divorces pa skau and apne bche ke cuatody b

dear client as per your query I can only suggest that you must have tried all means to be with your life partner because of ur child but what better u want from him atleast discuss about that which hasn't been discussed in this platform and mutual divorce can only be filed when both the parties are agreed and give joint affidavit it's not that u r financial strong your child needs because of him try for it as divorce is the last option when nothing can be sorted out for future paid consultation please contact us with your relevant documents.

Actually ,you need to try first mutual consent divorce if possible ,if not possible then move divorce under section 13(1) and also demand custody. If you think that it's all will not work go for maintenance and domestic violence petition. And above all lodge FIR against him, then negotiate with him.

As you have written in your problem that you have been married for more than 10 years and you have a one year old son who is with your husband and now both of you want to separate through divorce and there is no fight or litigation between you. Bet if both of you do not want then you can file a divorce case under area 13thIt will be built within 6 months and there is no dispute of any kind in this, both of you can get divorce with mutual consent and you can also file a case in the family court of area 11 for the custody of your son. The right is yours and if you are financially strong then it is easy for the child too

Madam, agar aap bina jhagde ya shanti se divorce chate ho tou uske liye aapke husband ki sehmati jaroori hai tabhi aapsi sehmati ke adhar per mutual consent divorce petition file ho saktee hai verna aapko contested divorce petition file karni padegi. sabse pehle aap police complaint apne husband ke khilaf darj karwao aur gharelu hinsa evam maintenance ka case file karo. phir section 13(1) hindu marriage act ke tehat divorce petition file karna. yadi bhavishya main koi aur kanooni Salah ki jaroorat ho bataiyega
