My wife filed impotent case on me. Can I say no to the medical test and can I appeal to high court? First she filed sec 9 on me. I filed sec 131 ia on her.

That there are statedaws under Hindu Marriage Act, which states that any spouse can file a divorce on the basis of impotency, where you can take defence on the base of your fertility of medical documents. Well you have a right that you can deny for the medical examination as well as you can challenge the order of the court in High Court

you can contest the case. it is for her to prove you are impotent. medical test you can deny. basing of other allegations you can easily come to conclusion if the allegation is correct or not. you can deny for medical test and if the trial court allow the petition, you can go to high court.

declining to take a medical examination will go against you in court.

it would only go to show your guilt.

where a charge of impotency has been made by wife, court will order a medical examination of the husband.

You can submit the medical certificate but you need to get the medical certificate from government authorities hospital or government doctors.

you can disagree but a medical test and if family court agrees and orders you can go on appeal to High Court on that basis. In this regard her filing of RCR under section 9 will be a ground in your favour. But you have not stated what is your standing this matter .

Hi,
Matrimonial cases are tricky. If you have taken the fertility test in a private lab, without the order of the court, your wife can object to the authenticity of the result. She may pray to the court to subject you to a medical test in a government facility or any other trustful lab... better consult your advocate and get clarity...
