Questions Answered by Advocate Sugumar Muralidharan

Q: Can i cancel sale agreement which done 20 years back ?

In 2002 we did a sale agreement to sell land and it's registered ( Showing in EC).The sale didnt happen and we did't cancel the agreement. In EC the summery shown as 1year deadline for the agreement. How can i cancel it now? Without the buyer details can we cancel the agreement? Can i sell the property without canceling old agreement ?

Advocate Sugumar Muralidharan answered
Hi first of all the 2002 agreement has to be read before giving advice on this. However I suppose that the recital must say that the buyer must pay the pending consideration within a stipulated time period. I again suppose the buyer didn't pay the remaining consideration amount as agreed... Now you can sell the land after getting a proper legal advice from an advocate

Q: Mother gave all property to son. Daughters left with nothing

My father passed away many years ago. My Mother wrote all properties in my brother's name. My 2 sisters and myself (woman) are left with nothing. We're muslim family and I want to know if I can file a case for my father's assert and get a share.

Advocate Sugumar Muralidharan answered
Hi,first of all inheritance of properties is based on personal laws. Since you are Muslim, only shariat law is applicable to you. As such if considering that the properties actually belonged to your father, then the settlement made by your mother is null and void.

Q: My wife filed impotent case on me. Can I say no

My wife filed impotent case on me. Can I say no to the medical test and can I appeal to high court? First she filed sec 9 on me. I filed sec 131 ia on her.

Advocate Sugumar Muralidharan answered
Hi,Matrimonial cases are tricky. If you have taken the fertility test in a private lab, without the order of the court, your wife can object to the authenticity of the result. She may pray to the court to subject you to a medical test in a government facility or any other trustful lab... better consult your advocate and get clarity... If you need any assistance pls call me...

Q: Case is disposed as this petition is dismissed as not pressed

Hello, I have sent a notice to wife before filing the divorce. however she filed the divorced with false allegations. Case was going for year+. Later she agreed to give divorce and said in the court which was recorded. I was supposed to get the order last week. The day before she filed a memo to withdraw the case stating that she want to get back. However I am not ready to get back. Currently Case is disposed as this petition is dismissed as not pressed. What can I do as next step? Thanks!

Advocate Sugumar Muralidharan answered
You can file a fresh case for divorce stating all the facts including withdrawal of this divorce case by your wife. Before that get certified copies of the whole case bundle and file them as documents in your new case... If you need further assistance pls call me

Q: Charges for FIR quashing in high court both court and lawyer fees and

Jst wanted to know that for filing of quash petition I was charged 30k by my lawyer. What would be the actual fees of lawyer for quashing procedure each hearing

Advocate Sugumar Muralidharan answered
The charges for advocates differ as per their ability, talent, expertise in law, etc., etc., Say for an example for the same quashing of FIR, well known advocates like Mr. Dushyant Dave, Mukul Rohatgi etc., may charge in lakhs... Some advocates May charge in thousands... So there is no yardstick for calculating an advocate's fee
