Q: Can i file a defamation case on my ex nd her parents

So i was in jail for a month because of a fake case from my ex on this sections 323, 504, 506, 354(B), (C) R/W 34 OF IPC AND SEC.66(E), 67(A) OF I.T ACT AND SEC.3(1)(w) OF SC/ST (POA) ACT after i got released from jail she wanted to get quashed, but because of this case on me nd my parents I'm not able to work or do anything, so what can i do

it's not defamation, it will be malicious prosecution. you may file the case of malicious prosecution, if you have successfully come out of the allegations labelled against you. otherwise, it will not succeed and defamation is not acceptable in such situations

Q: Summons from court in cheque bounce case

Hi, I have got summons from court for a cheque bounce and a date is given to appear. Should i pay any amount in court before the first hearing. I approached few lawyers they said that i need to pay 15K in court and its like a bail. Should i pay 15K and what is the furthers steps in this

you have to pay bail bond surety etc to the court. the amount may vary depending on the amount of the cheque and on this advocate has no hand. you have to pay that amount. it is the discretion of the judge

first of all getting bail itself is a huge issue. why you want to cancel the bail. you need not cancel any bail. if the police comes to arrest you, you can show that and get bail easily and if you doesn't come also, then also, just keep it.

Q: My wife and her family members threatening me for past 1 year

My wife and her family members threatening me for past 1 year and they say that it will not repeat. But still they are threatening. We have a son of age 2. They didn't even let me see him for past two years. They are saying that i am not living with her. I am ready to live with her but provided my safety is ensured legally.I ask this because if i go and live, just to get me into trouble they will simply self-injure and file a complain in police. Is there any way to ensure safety legally.

you give a police complaint and legal notice through an Advocate. describing everything and ask her to join you as a family. in that case before joining in stamp paper both of you can enter in an agreement and lead family life. both of you will be safe

yes, both the options you can avail so that no one misuses the cheque. you should narrate the entire incident and thereafter give a written complaint to the police station and enclosing the police complaint you can inform the bank also to stop payment. otherwise anyone misusing the cheque can trap you.
