My husband is not interested in living together

29-Dec-2023 (In Divorce Law)
My husband is controlled by his father. He don't allow me in his house. We lived separately for few months nearby. But on every pretext he keeps on calling him, my husband used to go and stay with him. I was all alone with 1 year old baby. I am working also. So it was getting very difficult. We had fights, now my husband is dissolving that rented house and saying that I can't come to the house where he is living currently. I am living with my parents and baby. I don't know what to do and how to proceed, he never do anything for me and my baby. His father treats him like a teenager and he don't want to see him, getting close to me and my son. I am doing all expenses alone and raising my son with my parents support. Please suggest me how should I proceed?

Staying with your husband and getting maintenance and support for the running of your family is the marital obligation of your husband. He can’t escape from it. In this scenario you can immediately file a complaint in a women cell to settle the dispute and you have all your legal right to stay with your husband under the same roof. So the women cell complaint would be a resort. However for better strategy of the case, more discussion is required. Please feel free to contact Thanks

If your husband’s behaviour is intolerable towards you then you can always file a complaint against him with the police station of your area. And then you can go for filing of DV and claim your monthly maintenance and a separate residence also. There are many options for you. For more legal assistance I am just a call away.

Your next course of action depends on what you intend to do- if you wish to file for divorce then the proceedings are separate from a maintenance application. The cost of filing can only be determined after a detailed conversation so kindly contact for further discussions.

Yes, you have stated correctly. You may file a case for maintenance as a right for yourself and your child. You may have to file an income affidavit at some point. In the case that he is capable and chooses not to maintain his family, he shall be obliged to fulfill his responsibilities.

If your husband is not following the agreement which was signed in front of the counselor then you can again file a case of under Sec 125 & also if you do not wish to stay with your husband then - a divorce case can be filed on your behalf.
