Q: FIR Filing Criminal Complaint for a Civil Matter

If a FIR has been filed by a person against someone for a civil matter, painted as criminal matter. The complainant has threatened to destroy lives of accused and people related to accused, a few days before filing FIR and some evidence is there that the accused were involved with the complainant in a civil/personal matter and this has been only done to escalate the issue out of ego. During the course of these proceedings the complainant tries to threaten the accused multiple times indirectly.

Q: GST charged on Maintenace by builder. Corpus refund

HiI bought a 3 bhk.flat in Bangalore with Jains Aashrya builders. During that time, they collected the advance of 2 years with 18% GST. I realized that later and now that i m asking for refund he is not agreeing to that.On top of it he did not given any GST invoice too. He also collected corpus amount which also is not refunded.I do have receipts for the payment done.Please guide

Hi. If you have the receipts against payment during the purchase of the flat then that can be used as evidence to initiate appropriate proceedings before the builder. It will be possible even without proper GST invoices. Kindly contact for a detailed discussion and analysis.

Shall I submit Written arguments again, when Vakalath filed and all the Docs transferred from Dist. court, to State commission appeal and case is under hearing stage, meanwhile , shall I change the status from in-person to Lawyer appointing to handle my case

Q: customer IS NOT READY TO PAY FOR ADDITIONAL WORKS

Hi, We are into interior business. We do turnkey projects. one of our customer is not ready to pay for the additional works done on the site. we have provided her the primary estimate for the works involved. also we have shared the additional work list ( without costing ) while executing the project. Our stand is either she pays for the additional works or let us remove the additional works/ products installed. She does not agree to both. how should we proceed legally to get back our products.

Greetings. Initially a notice can be issued to the customer. If they are still not agreeable then a suit can be filed against them due to non payment of the amount due. Please contact for further discussion on this issue.

Q: FIR Quashing ,legal rights to stop the matter

One of my relatives had a bad breakup. As he was under stress, depressed and suicidal, he thought of venting it out last year in a 15-page letter to the girl. But the girl filed an FIR in a non-home state where she is married. Now, over the past 3-4 months, the guy's family has been receiving calls from the local police station asking them to visit. The police are not threatening but rather asking the guy to visit. What are the legal rights of the boy, and is it possible to quash the FIR?

Greetings. If an FIR has been registered then in such cases quashing can be filed before the High Court. We will have to analyse what has been written in the letter and the circumstances surrounding it. it is also important to understand what is the nature of the complaint that has been filed for which coordination with the police is required.
