Questions Answered by Advocate Akanksha Choudhary

Q: Contempt of court Against Staff Selection Commission

Sir i and other 48 candidates of SSC CGL 2018 we\'re debarred from further selection process of SSC CGL 2018 on ground of missing signature in Tier 3 of the selection process. CAT ruled the case in our favor on January 13 2023 and ordered to complete rest of the process in 4 months. Commission took no action so we filed Contempt case and notice has been issued. Will it force SSC to complete the process or they can still evade. What if they still do not comply.

Advocate Akanksha Choudhary answered
Ideally in Contempt cases the court holds the concerned officials accountable for implementation of the order passed by Ld. CAT. On non implementation there are further strict remedies. If the order is appealed in HC then strategy has to be discussed accordingly. I will have to go through the relevant documents to assist further so kindly contact for the same.

Q: Waiting panel expiry even though the matter was subjudice.

I filed a case in CAT when my waiting panel was still valid (5 months before the validity expiry), and the judgement came in my favor after 2 months of the validity expiry. Now department is not honoring the judgement saying that my waiting panel has expired. Can a waiting panel expire for the petitioner when the matter was already subjudice under CAT? Or is that an excuse they are making and I need to take further action on this?

Advocate Akanksha Choudhary answered
Hi. It will depend on the daily orders that have been passed by Ld. CAT and the final judgment. Incase the Court states that the waiting panel is subject to outcome of litigation then you may have some remedy. Please contact me for a detailed discussion so that I can assist you further.
