I am a delhi based business man. couple of weeks age I went to a resort along with a few friends. There I got into a situation, where I get involved in physical intimacy with on of my friends wife.It was purely consensual. Some how the lady feel guilty and confesses to her husband. He is now threatening me to drag me tho the court and damage my business.Just I want to know is there any legal situation can occur here as we both consent for it?
Advocate Anjali Sharma answered
No.. As it was consensual.. Both were agreed and it wasn't forced. And now the adultry is also not punishable under law. It is a choice. But you can save the chats and recording if in case they file any case. You can produce them and show that they were threatening. And if you are facing any difficulties or threat from them, then you can file a FIR.
Q: My husband is not interested in living together
My husband is controlled by his father. He don't allow me in his house. We lived separately for few months nearby. But on every pretext he keeps on calling him, my husband used to go and stay with him. I was all alone with 1 year old baby. I am working also. So it was getting very difficult. We had fights, now my husband is dissolving that rented house and saying that I can't come to the house where he is living currently. I am living with my parents and baby. I don't know what to do and how to proceed, he never do anything for me and my baby. His father treats him like a teenager and he don't want to see him, getting close to me and my son. I am doing all expenses alone and raising my son with my parents support. Please suggest me how should I proceed?
Advocate Anjali Sharma answered
You can file contempt petition against your husband for violating the terms and conditions of the agreement. Charges and punishment under contempt are very strict. We need to see your jurisdiction as per the agreement. For further details you can contact me
