My husband is not coming to take me to the house.

I had love marriage.its been 10 months.abut after marriage my husband started to beat me. After 4 months my mother in law got expired. He blamed me that his mother died because i married to him.. I am also having some health issues after marriage..it got worse after he beat me..so I cant do some house work..last moth when I was ill he slapped me and pushed me for not doing household work..so I call police at home..after that they told me to go to your relatives home for 1-2 month..my husband leave me at relatives house..and now my father in law is not allowing me to come home.my husband is also not coming to take to his home..they are saying come with your parents..but I had married to him against my parents wishesh. They were not their at marriage. I told my husband but he is saying then we would take divorce then..what can do if I want to there? I cant go alone. Is there any legal safty that I can take before going there??

in this case you can take assistance of local police station for entering your matrimonial house. if the physical and mental harassment still goes on then you can proceed to file application to magistrate under domestic violence act for residential rights and other reliefs.

you can also proceed to file restitution proceedings before family court for directions to your husband to take you to matrimonial home and resume cohabitation

Your suffering through critical and serious issue..

What I had understood so far after reading your matter.. That you don't want leave (divorce) your husband.

You can file suit called restitution for marriage where you can force your husband till some extent to take you home...

Or file domestic violence for maintenence

Or file case u/s 498A of IPC.

Hello, your case is falling under catagory of restitution of conjugal rights. you can still compel your husband to co habit with you by approaching to family court under Sec. 9 of Hindu Marriage Act. Also, you can obtain protection order under DV Act and maintenance amount too.

In this case, you can ask the local police to enter your matrimonial home. If the harassment continues, you can file a complaint to the magistrate for relief under domestic violence law.
