Legal ways to file for divorce free of cost

14-Oct-2023 (In Divorce Law)
I am a primary school teacher with very limited means. I have two minor sons and I would like to seek divorce from my husband, with whom I have not been staying for almost 7 years. My husband has never visited me or even paid me a single penny all these years for myself or my sons. Is there any NGO or legal forum, that can offer me legal support free or at a minimum cost to fight my divorce case? I am not sure if my husband will be graceful enough about mutual, maintenance or even custody. So I am very worried and stressed. Please help.

Yes you can share your details. It depends in which city you are staying or your marriage was solemnised. You need to meet or consult some reliable advocate. I am sure you will find. Unless you provide details of your place of residence or marriage the concerned details can not be provided.

Firstly, receiving maintenance from your husband is your legal right and you can claim it for yourself and your sons under Section 125 of Cr.P.C.
Secondly, there is an NGO called, Lawyers Collective which can provide legal aid. As far as your legal expenses are concerned, there is provision under the Civil Procedure Code under Order XXXIII, Rule 1 to move an application wherein the Court may allow you to file a suit as an indigent person. However, I would suggest you to move an Application under Section 24 of the Hindu Adoption and Maintenance Act, 1955 wherein you can claim from your husband all the expenses of the legal proceedings against him showing you don't have sufficient means to pay the expenses of the proceedings.
Lastly, if your husband is not living you for the past seven years it is one of the major ground to seek divorce against him under Section 13 (1)(ib) of the Hindu Marriage Act, 1955 which provides desertion as a ground for divorce.

Yes of course you can file divorce petition against your husband and also you can claim maintainance as well as child custody.
You have sufficient grounds to fulfill the essentials of divorce petition.
And if you need some pecuniary help from NGO I'll refer you one of them by which can get economic support from them.
