Filing for Mutual Divorce Online. Marriage not consummated.

01-Aug-2023 (In Divorce Law)
Sir, wife is from kolkata, husband from Bangalore. Registration happened in kolkata. Marriage has not consummated. Less than 1year since marriage. Can we file mutual divorce online? Can exemption be made on time limit?

on the ground of exceptional hardship or irretrievable breakdown of marriage the period of 1 year can be waived by the higher courts. it would be better in such cases to get the order from high court to proceed with such divorce. unless you want to conduct your own case its advisable to get your counsel to file your case.

To give opinion, it is necessary to know the date of Registered marriage and Social Marriage( if any) and whether the Divorce case is going to be filed at Kolkata or not. If you wish to take my Legal opinion professionally upon online payment, then can whatsapp.
