Divorce on the ground of cruelty

My sister is married to a guy for almost 6.5 years. Of late the guy started behaving in a strange manner. He starting beating her. He plotted a false suicide drama of himself. We have been helping this guy financially all through these years. Now we don't see any point in sending our sister back to his home as we don't see a secure future for her. The guy is not doing well in his career and behaves weirdly on occasions liking abusing, beating demanding money from my sister. We have made a FIR against him. Kindly advise how can we proceed further to get her separated from him and get our money back which we have paid him all these years.

please ask your mother to file a domestic violence case against her daughter in law and state that she is harassing and torturing her and making her life hell and in that regard, your mother can also state that the daughter in law is also threating to file false case against the entire family and extract money

In my opinion your mother can file domestic violence case in this regard . Otherwise lodge a complaint to the local police station in this regard. And without detail discussion proper consult is not possible.

You should readily approach a Advocate at first. File a police complaint against the wife, better to file the complaint by the Mother! Then file a divorce petition on the ground of cruelty before the Family Court attaching all the treatment documents of your brother.

Said to here that.. well if there are no chances of reconciliation between the two..than probably get separated is the best way. Ur sister can file divorce on ground of cruelty under section 13(1)(1a) of hma and in the same petition demand her streedhan, expenditure towards wedding and even litigation expenses and also claim maintenance in case she is not working under section 135 ctpc and file a separate domestic violence case where again she can claim damages and maintenance. Dear client as far as f.i.r. is concerned that make out a crminal offence under respective sections of IPC In relation to family dispute the wife may also prefer an application for maintinance from husband before family court and she also has a remedy to file a complaint under section 12 domestic voilence act. Consultation to your Lawyer is required.

Sir, Institute the matrimonial proceedings under section 13 of Hindu Marriage Act to get your sister divorced. Cruelty and demanding money are sufficient grounds enough to get a decree of nullity of marriage. Further the permanent alimony may also be claimed which shall compensate the expenditure by you.
