It has been 6 months since our marriage and from 4 months we are staying separatelyCan I File under Divorce on cruelty ground-Section 13(1) (ia) of the Hindu Marriage Act if he is ready to admit it so that we can get a decree within a month and get free from this situation? Is it possible?
No. In order to file divorce petition under section 13(1) I A of Hindu Marriage Act, there has to be 1 year separation. This is mandatory condition to file divorce. As for cruelty ground, you will have to prove it before the court. If you go for mutual divorce then it will be quicker
