Divorce but my wife denied to do

Me and my wife we are not staying together from last 2-3 year, we don’t even communicate anything except top of divorce, We are not physically active from last 5-6 years. My wife only come to house just to meet our child. To proceed in my own life I want divorce from here but she is giving me the reasons but she is not supporting for divorce, now i can’t stay anymore what would you suggest me do ? What exactly I can do to get divorce in India as we are Buddhist.

Hello you have to both get ready for mutual consent divorce which is most suitable way for both of you by sharing custody of children or giving access to custody of children, you both need to go through counselling sessions to get free from this marriage

You may file a contested divorce Petition in the concerned family court by narrating your plight and can ask for divorce from the Court on the grounds of cruelty and desertion. If you can even prove the ground of Desertion (i. e. wife is not staying with you for more than 2 years without any valid reason and deprived you of her company ) the court will grant you divorce.

Well, in order to seek Divorce from her, you have to file a Petition in the concerned Family Court to seek Unilateral Divorce under the concerned provisions of the Hindu Marriage Act, considering, in India, Marriages amongst Budhists falls under the Hindu Marriage Act.
