Appealed a divorce but am I able to file a case against respondant.

06-May-2024 (In Divorce Law)
Marriage was happened in NOV, 2019. My husband is currently diagonised with HIV positive but with some research on him. I found that he has been infected with HIV before our marriage for which I have the voice recordings of the doctors statements but no official evidence. but this can be proved when the court orders him to get tested HIV test. But Am I or any of my family member is eligible to file a case against my Husband under IPC sections 269 and 270?

My suggestion would be instead of filing for divorce, file for annulment of marriage(cancellation bot marriage). You won't get a get a tag of divorcee. You can claim compensation for the money, time and for other things. Coming to the IPC you can a complaint not only under 269,270. you can press cheating and other charges. Talk to a lawyer and explain him the situation, he will include as many as IPC sections to teach him a lesson. him as in his family as well. Nobody reveal this to you. All the best

hi you could file a petition in court for annulement of marriage on the ground that the disease was not informed to you and you could file a petition for medical test and you could give a complaint under section 269 of IPC
