Contested divorce filed by my spouse. I dont want divorce.

Me and my husband has first filed for mutual divorce. But after that my mind changed and I decided to withdraw. My husband has then filed contest divorce and court has sent me summon to appear in court. If i dont appear, then what will happen?

Ex party order will pass if you will not appear before court so better to appear and submit your points before Family Court for more clarification you may contact us then I'll elaborate properly about your case Advocate Anurag Bhatt Allahabad High Court

if you don't want to give divorce to your Husband and the mutual petition is disposed off by the withdrawal and your husband filled a fresh petition of divorce and court summons you then you have to appear in the court because if you are not appear then cour gives order of divorce in favour of your husband and that order called ex parte order because court consider you the case ex parte

if you don't appear continuously for 3 dates then court may proceed ex parte decree against you after that you have to file appeal so it would be better for you to appear in court...for further information you may call me

As you have told in your problem that you had filed a divorce suit with your husband on the basis of mutual consent But you don't want divorce by mutual consent then you withdrew that application but your husband is completely ready to take divorce from you and he has filed unilateral divorce caseIf you have been issued a summons from the court, then you must present your side in the court, otherwise the court can give divorce by taking ex-parte proceedings against you.

if you don't appear after receiving the summon issued by the family court then in that case the court will proceed Ex-party against you. if you not appear in the court then court has assume that you not Interested to respond and suit going on ex parte proceedings and after that court allow to petition and order in favour of your husband. for more information you can contact me.

you can be imposed with conempt of court and can be imposed with the fine. also if u will not apper in the court then he will be eligible to get exparte decree in his favor. so i will request you to get appear in the court.

Exparte Divorce can be called off and one can put an application for a chance of justification in Court. The absent party can justify a valid reason for not attending the date. In that case, Court may call off the Exparte decree of divorce and case can be revived.
