What happens if I don't bring any surety in case of Bailable warrant?

21-Oct-2023 (In Criminal Law)
I am the Prime Witness but due to some circumstances I couldn't appear in court till now. But now there is a bailable warrant issued. The court order reads like "Issue B/Ws in the sum of Rs.5,000/ with one surety in the like amount   against  PW  through   SHO   concerned,   returnable   for NDOH." My question is if I fail to bring any person for surety on NDOH, then what are the other options I will have? Will I be arrested or let go on deposit of 5000? Or bringing a surety is mandatory?

You need not worry. It's just a bailable warrant issued against you. And in case you failed to bring any surety on the next date of hearing you can either ask for another short date or you can also request the court to accept the personal bond rather than the surety bond. Just keep anything that belongs to you above the value of Rs.5,000/-.

If you are unable to bring a surety on the next date, don't worry I can file my vakalatnama on your behalf and furnish your personal bonds which will give you one more opportunity to bring a surety in the court. For assistance you may consult me.

If you fail to attend court, you may be subject to processing under section 81 and required to pay outstanding fees and provide surety on the next court date. Failure to comply may result in arrest. Please contact us for further advice.
