Non registration of FIR by police

Sir, if my complaint is not registered by SHO and there after by SP or DCP of the district then we have to go to court under section 156.3 crpc for giving direction to the police to register FIR if my complaint shows commission of cognizable offence. My question is that as supreme court in lalita kumari vs state of UP judgement has said that police is duty bound to register FIR if complaint shows commission of cognizable offence, then can I go directly to supreme court in place of 156.3 crpc to MM court for contempt action against SHO and SP that they have not register my FIR so that my FIR can get register at the earliest as MM court in 156.3 takes very much time.

Your partial information is correct but however I would like to correct you in certain aspects. First you need to share the complaint with me that you intended to get registered with the police and was subsequently rejected by them. Then I’ll point out the grey areas and advise as what should be in the complaint or not. I am an advocate for Delhi Police and will suggest you the best possible method that can be at your disposal.

If you have filed a 156(3) then the police officials are duty bound to file a ATR in the court of ACMM. If in the ATR it’s mentioned that there’s a need for registration of FIR then the magistrate will call for the FIR to be registered and if not the magistrate has got it’s own power also to get the FIR registered.

How are you Apple is your refuses to register the FII are you have the remedy under section 156 bracket 3 to approach to the concerned court and even the concerned court refused to register their fire then you can file the revision against that order and then again if you're not satisfied you can approach to High Court and then ultimately to supreme could you can't go Supreme Court directly thank you
