what is the procedure to clear the stamp duty of previous owner

I am the 2nd owner of a flat in Y. I'm looking to sell, but i have to clear the previous owners stamp duty. Currently all my original documents are with the bank as I have taken home loan. Somebody told me I need to have Original allotment letter if i have to pay the stamp duty. Is this correct? How can I pay the stamp duty and penalty? Where do i need to go to find out how much exactly i'm suppose to pay? What documents are needed? How much time will it take to clear this payment? Do/can banks pay on our behalf as they have the documents?

if the documents are registered then the stamp duty is properly paid. if you have already paid the same then there is no need to pay again. there is no need to have original allotment letter and if there is deficiency in stamp duty then you have to pay the deficit amount only by applying the same before IGR (Inspector General Registrar). Bank would pay according to your instructions.

Things in your case is of matter of property ownership and agreement.
First you have to claim that your property ownership belongs to you.
Then the later on what ever transaction of regarding sale and purchase of property and other terms and conditions can be inscribed on agreement for sale.as per the transfer of property Act .
