Q: Action against the govt. department for claiming our property

Hi, In this case Home Department (Govt.) Claims that the property where we are staying for more than 25 years belongs to them.. the case was filed by them against our landlord but we have losen up in case.. Please help me out to how we can claim property is belong to us???

first of all you have to go in appeal against order by the court in superior court. and apply for stay order for the same. Is there any lease deed/sale deed between your landlord and government? you have to prove your landlords ownership then only you can claim the property.

Q: Case pending from 8 years without single hearing

Hello, my case is pending in metropolitan court from last 8 years, government body who has filed case against me are hardly present on dates if they are present opposition government advocate is not present its been 8 years the case is pending at the same stage, all the pointers are in my favour but not getting room to express, how can i appeal to court for quick r

first of all you have to inform the Hon'ble Court about the day book since 8 years of the case. then the court will either consider the same and dispose the matter or you have to apply to the court for further stages.

Q: what is the procedure to clear the stamp duty of previous owner

I am the 2nd owner of a flat in Y. I'm looking to sell, but i have to clear the previous owners stamp duty. Currently all my original documents are with the bank as I have taken home loan. Somebody told me I need to have Original allotment letter if i have to pay the stamp duty. Is this correct? How can I pay the stamp duty and penalty? Where do i need to go to find out how much exactly i'm suppose to pay? What documents are needed? How much time will it take to clear this payment? Do/can banks pay on our behalf as they have the documents?

if the documents are registered then the stamp duty is properly paid. if you have already paid the same then there is no need to pay again. there is no need to have original allotment letter and if there is deficiency in stamp duty then you have to pay the deficit amount only by applying the same before IGR (Inspector General Registrar). Bank would pay according to your instructions.
