Stay order for construction in a joint property

04-Aug-2023 (In Civil Law)
I'm a owner of a joint property which is almost 60 yrs old, i would like to make some alteration (RCC my roof and to convert double rooms to single) in my share of the property. I did consult an engineer and they approved it. My concern is that, is it possible for the other (neighboring or nearby owner) to bring a stay order from court, claiming that the building is old and my construction work would affect their area, if they can what action/precaution should be done from my side. Kindly try resolve my query.

Yes Your neighbor can file a suit and may also seek injunction against construction. However if you anticipate any such action you can lodge a caveat. In such an event court will hear you before granting any interim order including injunction.
