Received blank cheque and wants to know legal steps if it get bounced

Hi Sir/Mam, The person borrowed some amount from me. He has given the blank cheque only with Signature. I have filled and submitted at bank. Is possible to file the case if that cheque bounce. If anything wrong, please advice. its huge amount.

If it is bounced you can send legal notice to the drawer and thereafter if he doesn't pay, you can file 138 of NI Act complaint before the stipulated time as per the Act. Simultaneously you can also file civil suit for recovery of the cheque amount.

You can file cheque bounce case against that person but u have to initiate the case within stipulated period othetwise you will loose the opportunity to file case. First send legal notice to that person

Dear Sir / Madam - If normally this sentence give (Just mention signature,not mention any status for cheque date, not mention A/c pay), If the cheque bounce normally case should file -( Under This Methods - Cheque Signature,A/c Pay,Only Signature not mention date this methods follow this method under this The Negotiable Instruments Act,u/s-138,notice period-30days,punishment-2years),(If cheque mention date its normally validity 3months only) - Regards (KAMALAHASAN M)

After bouncing the cheque amount you will give legal notice within fifteendays the date of bounce asking him to pay the cheque amount. If he fails, then you can file criminal case against him u/s 138 of NI ACT.
