I am the complainant of a cheque bounce case. CMM court pronounced judgment in my favor asking the accused to penalty. The accused appealed to the sessions court which was dismissed. I want to move 1A for advancement and withdrawal of the deposit furnished by the accused. Can I do it on my own? If so where I can I find the format of the application forms.
Dear Sir,
You can advance the case by filing application for advancement by showing disposal date of the Trial Court and such application should be filed before the Trial Court. Further, you can file one memo along with your Aadhar Card enclosing judgment of Trial Court and Appellate Court claiming withdrawal of deposit furnished by the Accused. You can write the same in your own style only the condition that the cause title to be disclosed at the top of such advancement application and memo.
