Legal Demand Notice Returned Unserved

I had sent a legal notice of cheque bounce to the party to two available address of himBut the party left one address whereas on his current address he bribed the postman and got an endorsement address "incomplete or wrong" and my notice returned. What should I do now? Would court consider my case in this scenario

Yes absolutely, the court would certainly consider your case even if the notice returned unserved: in such cases, the only thing that is required to be proved is that the complainant had sent the demand notice to that address of the accused which, as per the complainant, was his last known address and that address was correctly spelt out on the envelope without any mistake.

You need to hire expert advocate in this case bcoz if your current advocate doesn’t know what to do during this situation then u must explore second option ! Anyways we need more details on the case ! If u think address is correct u can file affidavit in this regard!

If you are in Limitation period for sending legal notice, then send that legal notice on whatsapp and email.
If not, then rely on presumption of law for service.

According to the Supreme Court's decisions above, if a notice has been sent to the correct address, it is deemed served, unless the contrary can be proven. When the notice is returned unclaimed, then it will be considered to have been served.
