How the PDC cheques payment clearance can be done

I Received two PDC cheques different dates but when I was present the first cheque that was stopped. When I called him he told me wait I'll tell you date to clear amount but he isn't not cleared amount after the 45 day's And second cheque date also over First cheque date is 30/06/2018 Second cheque date is 30/07/2018 Still not clear the payment

After check bounce, before 30 days u should have to send notice to them but now already 45 days over so more than 30 Days
So need to bounce both check again n then can send legal notices to them for further action

If your cheque are not cleared by the drawer then it means he is not intended to pay his liability you can re deposit the same and serve the drawer with demand notice to clear payment if not you will file criminal complaint against him under section 138 of Negotiable instrument act

You can submit the first cheque in its period of validity otherwise you have option to deposit another cheque which is with you. After dishonour of the cheque you have to give statutory notice within 30 days to the accused. After service of the notice you have to file criminal case in the competant court within 30 days from the receipt of the same notice to the accused.

I am under impression that person given you cheques for his legal liabilities. Two options you have to recover your money...complaint before magistrate under 138 negotiable instruments subject to norms fulfilled. Or Civil suit for money recovery,

Validity of cheque is three months, if the cheque is not honoured, you need to send demand notice through advocate within one month of cheque return thereby giving fifteen days time to the drawer of the cheque for making payment. If the drawer fails to honor the demand, then legal case should be filed under section 138 of Negotiable Instrument Act with one month from the expiry of the demand notice period of fifteen days.
