What is the legal procedure to change the lawyer

21-Aug-2023 (In Banking / Finance Law)
Hello, I'm a 67yr old person with heart problem. Have been waiting for more than 9yrs for my case. There were a few hearings in between but mostly its been pending. My lawyer is not taking interest in the case now. Doesn't attend me properly and even behaves rudely sometimes. I've paid him full fees also but I'm totally dissatisfied with the way he is treating the case. I want to change the lawyer now. Please guide me whats the procedure for that. How to make sure that he cannot interfere or obstruct the process. Thanks

Dear
If you want to change your Advocate in a case which is pending in the court. You have to take no objection certificate from old lawyer's. That no objection certificate hand over to new Advocate to whom you want to engage.
This is the correct procedures to change the Advocate.
Thanking you

Generally in such situations non payment of fees remains the core issue, but as you have suggested that you have paid the entire fee settled between you than you can comfortably ask for "No Objection Certificate" from the lawyer without any ill-will. Such kind of change of professional service is your right, it is generally done on the Vakalatnama of another counsel or a plain Vakalatnama but a separate certificate can also be asked, in that case get it mentioned that no balance fee is pending, you also need to give in writing that you have received your documents/ case file etc.
