Q: How to deal with a false DV case

Hello I got married in 2006 by Hindu law and I have a child age 8/9 yrs. My wife torture me and my family. She threaten me to kill me whenever I come to Jaunpur from my work area eg Mumbai. She having affair with my married older brother (uncle's son). I filled Divorce case in 5 nov 2015. Than she filled a violence, dowry etc cases against me on 17 nov 2015 with all necessary documents with the help (money to police) of my older brother. After 2 yrs I noticed about that case. I am surprised and so frustrated now. What can I do?

Dear Client,Looking into your case, my legal opinion is as under:I would suggest take your wife to good marriage counsellor, but remember out of love and affection do not forget to protect your and your parents i.e. family interest..... anything in limit is good but when if you can sense something is going bad or bad is above to happen other than going to marriage counsellor or trying to find the root cause of her rude, cruel behaviour, also try to collect EVIDENCE so that you can protect yourself.... remember Evidence can only protect you along with a good lawyer. for rest you can call and seek and appropriate counselling from me over the phone.



Q: Ex wife files for domestic violence after 7 yrs of physical separation

Got married in October 2010 as per Hindu rituals in uttrakhand.Ex wife went to training to Chennai in dec24 but didn't return and went to her parental home at Mumbai she got her transfer without informing me....I filled for rcr in feb but she didn't return...I got ex parte divorce decree in my favour in September 2012..N I got married again in 2013...In 2016 she filed for set aside..N it was granted by family court in uttrakhand...She also filed interim maintenance...She lost interim maintenance case in 2017 and exparte was again granted in my favour...Now she have filed domestic violence case and maintenance claim amounting to rs 70000 per month...She is filing dv case after 7 yrs of physical separation..She have filed this case from Navi Mumbai....Pls guide me...
