Can a husband divorce wife on the ground of dissertation

My wife left my home 3years back blamed me adultery kids are with me , she put 125 case on me and case in women cell also. I give my statement in women cell I want to take her back but se refused. Court ordered me to pay 3000 rs per month to her. Can I file a divorce to her she is now living with her parents?

yes, you can file for divorce. you can also opt for mutual divorce, which will take less time in the court, as your wife is already living separately for 3 years the divorce process will be finalized early. But depending on the court you will still have to pay her maintenance.

Yes, you can file the divorce petition as she left your company of her own and if there was any such issue related to adultery or any thing else then in that it should be in a written form. Also if at this stage you don't go for any legal remedy or take any legal action then it will be very difficult for you to take any relief from court. But if you still wants to give another chance to your relationship then at first file a petition under section 9 of RCR under HMA, 2005
