Notice to pay penal charges by Ranchi municipal corporation

My grandfather was alloted a space 79 Sq. Ft. For a shop approx 40 yes. Ago. He was running a shop there and paying regularly taxes. He constructed first floor & started paying taxes for both floor since 1996. In Dec. 2016, a notice was sent by RMC, to pay rs. 111368 as penalty charges with tax. My grandfather expired in April 2006 and grandmother is alive. If the construction was illegal then it should be noticed in 1996. We don't have any permission proof as it was never discussed by grandfather. After so long time, it has been asked. What should I do? Kindly give a proper suggestions.

at first you collect copy of notice which issued on 1996 and whether any reply filed by your grandfather to RMC ot not if file what action taken by RMC what is the action taken by RMC and What is the order given by RMC thereafter you can take legal precaution whether any order is recd your grand father recd on 1996/1997 you can first seen from office of the RMC thereafter take legal action

In this matter you have not disclosed that who had allotted the area to your grandfather and on what condition.
Please give full details as such proper reply may be given to you.
If there is any agreement regarding allotment of area please send copy of the same also.

You question has been blossomed forth in 1996 when your grandfather erected first floor and as per your query you said that since then incessantly tax had been paid. Later on in the month of December, 2016 you got a notice to pay penalty charges by the RMC. I would like to inform you that if the RMC was taking tax of said house then he can not raise penalty charges because they have already had tax, so he cannot raise penalty tax. Suppose, If you have not taken permission for construction of first floor and evading tax then RMC will take plea that it has come in knowledge in 2016 about illegal construction thenafter raises penalty charges. You have one option to take a plea that your Grandfather is the Karta of your family and he was looking or paying the tax and other matters of your family.
