How to file for contempt of court

Sir,received an order frm highcourt bench in our favour with the order saying the needed to be done in 3 weeks,the opp party has not done so... Keeps saying we are gonna appeal to Supreme court... It is gonna be 3 weeks soon & no news about a stay order against ours. My question is.. Do they have to get a stay order against us? & can we file contempt of court against them & will they avoid it by saying we are gonna appeal in Supreme Court? Thank you.

I guess you got order in W.P. The other party can go for appeal in HC itself in WA. But without any explicit order of stay by any competent court the other party cannot disobey the court order. You can send contempt notice after 3 weeks and proceed to file contempt petition thereafter.

If any order is passed by anycourt that should be obeyed without delay. Furthermore mere saying that they are going to file an appeal it would not help in anyform for your opposite party. Once it is found that the order of court has not been obeyed then you can file contempt petiton subsequent to issue the contempt notice.

You can file a petition to take contempt of court action against ur Opposite party and proceed further. He has to file a petition before Supreme Court or he can file a petition before the high court itself to a larger bench and get a stay on your order
