Delay in site allotment of site how to send legal notice

My friend's husband and his brother have shared and purchased a site in telecom layout Mysore 5 yrs back.now the person says because of mayor has changed, there has been a delay in site allotment and advised my frnd to wait for 6 months.till now, they haven't got back to her as its 5 yrs !! My friend wants to send a legal notice immediately to check y the allotment is delayed. Shud she run the case or to go thru court procedures to send the notice. Or can the notice be served immediately without any court proceedings or how to proceed ? They told they will allot a site in a different locality for the same amt.but my frnd wants the same site .her husband and his brother have paid in lumsum and they have the reciept for the amt paid and the application for site agreement

For Issuing a notice you need not go through any court proceeding. You yourself can also issue a notice to the seller before getting a legal notice is issued. ( A legal notice is essentially issued by a lawyer only ). But it always advisabl;e to send a notice after studying the agreement .

If there is full payment made for the site to the society and if the society has issued an allotment letter stating that a certain site with a site number mentioned will be given to the allotee then using those docs you can send a legal notice first

In your problem as you told there is delay in hand overing the site.

Madam, here first of your should see the agreement between the vendor and the purchser and find is there is a recital in respect of the completion of the project.

And here you can file a consumer complaint against the such vendors.

regarding the notice you raised in your issue, you can send a formal notice intimating them to hand over the position immediatly. In case if they failed to reply of given any reason then you issue legal notice.

Once you filed a complaint then court will issue notice.

Your friend has a good case, provided they work out on different angles. Trying through one mode may not work out. First get the site which they offer otherwise you may not get that too. Court proceedings may not give any result. Notice and police complaint may work. More suggestions in person.
