Can RWA implement restrictions on children for playing in the park

I just wan to have some enquiry that Can any RWA president impliments restriction on a public park that kids will not play in the park? As i know its a public place govt approved that how any residencial assiociation force it. Plz. Suggest if i can take any action against it.

RWA should be concerned with the society only. If they have passed any such law you may just ignore it as it is not relevant. If they use force or any other method you may file a complaint with the police as they are obstructing your legal rights. If they have blocked the entrance of the public park you may also complaint with police and also with the local authorities in your area.

Hi,

I have a Delhi High Court judgement also related to your case which will help you and it is clearly mentioned in that writ petition. Delhi high court has said that no one can prohibit children from using a park as a playground & also stated that The Master Plan of Delhi, 2021 in Clause 9.6 thereof permits the use of a district park inter alia as a children park, for sports activities and as a playground. Similar uses are provided for a community park also. In my view the use aforesaid of the park would fall within the permitted use and would not fall within the mischief with which the Division Bench was concerned in the judgment aforesaid.

No not at all any restrictions can not be implicated on children.Therefore it is there constitutional right as well.If someone raises an objection try to pacify the matter with him or even civil and Criminal remedies are available.

The RWA cannot claim exclusive ownership of the park. Therefore, any attempt to restrict the common man's access to the park or use is illegal.
