45 Years Old tenants - Rent only Rs. 50 per month. Not vacating house.

Respected Lawyer, Thanks you are providing free advice. Sir, my query is that my grandfather gave property before 45 years for rent. Now, the grandson of the property holder uses the property at a rent of Rs. 50 per month only. Not vacating the property. Any remedy to vacate the property from the old tenant or increase in rent as per present time. Can u advise please.

All tenants have to vacate the property, if the owner of the property is able to prove that he requires it. If you dont require it then you will succeed. It will be better to meet a good advocate of the area and take proper advice after showing all the documents of the property. You will be able to get a very good rent after vacation of the house. You can change the use from residential to commercial. You can make use of it according to your own choice.

Supreme Court have passed a judgement that a landlord cannot evict a tenant for at least five years, if the tenant has paid the rent regularly according to the agreement between the two parties. However, the owner can evict a tenant if he wants to use the premise himself.

There are other grounds too as your rent is below 3500, if the property is in Delhi..it will be Governed by Delhi Rent Control Act ..
