My aunt(father's sister) is claiming share in my father's salary

My grandfather was a government servant. In 2003 he died in duty period.So my father got the service and no one had objection with this. But now after so many years my aunt is forcing my father to give her a share in his monthly salary otherwise she will file a case against my father to claim the share in income. my question is whether she can file such complaint against my father? If yes ,how can my father defend himself.

we would like to inform you that your father is working in Givernment department on the basis of capationate ground and during the time of joining no one raised sharp of money but now a day your aunty is demanding share. under such circumstances you can fight but your uncle have also right to claim share on the basis of grandfather 's property otherwise they can claim on other property of your grandfather. your father is doing job which tends to your grandfather. you can fight on the basis of no objection of your uncle during joint of compassionate job.

There is no reason to fear for your father at all. Your aunty cannot do anything as your fathers service is independent on his own and has no bearing of anybody.

In case she files a complaint, let your father file a Police complaint for extortion as against your aunt, for illegally demanding money and share of your father personal property and earnings. She will be in deep trouble for causing such threats and actions.

Well, there are several legal questions which arises here.

1.Were your Father and your Aunt & her Husband living together when your Grandfather died?

2. Was Household running on the Salary of your Grandfather?

3. Where is your's Aunt Husband now?

4. Is your Aunt not financially independent?

5. Whether your Aunt's Husband financially contribute to her or not?
